Overseas Property Law - An overview

Whether buying property in Dublin or abroad investors should take the same caution and treat the purchase the same. In other words, if you were buying a property in Ireland you would ensure that you had independent legal representation, so there is no reason why your overseas purchase should be any different.


While many overseas developers and agents in overseas jurisdictions may offer investors the services of their lawyer, property buyers should be informed that it is impossible for this lawyer to offer you totally independent legal advice and look after your interests, as they will also be working for the seller. It is important to have totally independent legal advice to ensure that any and all defects in your contract are noted and disclosed to you (e.g. incomplete information as to the description of your property, or any clause that is not in your favour).


While it is a fact in many European countries, that the public notary undertakes some element of work and oversees the signing of the final purchase deed, they do not see any preliminary contract which you sign and therefore it is important that you get legal advice before signing any contracts and do not rely on the public notary on signing the final deed.
